MEMBERSHIP TERMS & CONDITIONS
Terms and Conditions as of 31 May 2022
1. Contract Terms. The below refers to the contractual Terms of Use related to Members of Find an Organiser (FAO) referred to herein as ‘Member’.
2. Ownership. The Website is owned and operated by Find An Organiser Pty Ltd (ACN 657 694 972).
3. Agreement. Members agree to be bound by the Member Terms of Use and the Privacy Policy published on the Website. You acknowledge and accept that you have read and agree to the Terms of Use, Code of Conduct and Privacy Policy published on the Website, during the course of this Agreement.
4. Governance. Your membership with FAO and these Terms of Use are governed by the relevant laws, rules and regulations.
5. Terms of Use. FAO reserves the right to change any or all of our Terms of Use by publishing the new Terms of Use on the Website. Your membership is subject to the most current version of these Terms of Use.
6. Business Listing. You agree and attest that all information and content submitted by you to FAO is accurate, up to date, belongs to you and is not in breach of any law or legal requirement. You agree and acknowledge that as a member, you are solely responsible for the content and information on your business listing and that all products and services offered by you accurately depict what you are authorised and capable of providing consumers. You, as a member, confirm and certify that you have all the necessary legal requirements in place to conduct your business and offer the claimed services (where applicable) including but not limited to certifications, risk and safety management and applicable insurances in place with respect to the services and products that you offer. Prompt notification of any relevant changes to your contact details including (where applicable) your email address, or of any changes to your ABN, bank account or credit card details and any other information you are required to maintain with us (where applicable). Your listing will be advertised on the FAO website and include details of your business name, services provided, service areas, relevant images and profile information. Your listing will go live within five (5) business days upon receipt of your payment, completed application and any outstanding information requested. It is the responsibility of the member to ensure listing details are accurate, current and up to date. You can notify us by contacting us directly at
info@findanorganiser.com.au. You understand and acknowledge that as a listed Member on the website, you are not contractors of, employed by or act in the capacity of agents of FAO.
7. Eligibility. To be eligible to list your business services, FAO members must provide full and valid business listing information as requested including but not limited to full business details, a registered ABN, current Public Liability Insurance and agreement to the Code of Conduct to FAO and its subsidiaries. You agree and attest that all information and content submitted by you to FAO is accurate, up to date, belongs to you and is not in breach of any law or legal requirement.
8. Payments. The charges applicable for FAO members is to register a business listing by paying for a membership or add-on promotional services. Membership fees consists of an automatic month-to-month or annual charge of an amount corresponding to the membership plan selected. Payment for the membership listing services will be automatic, via a third-party eCommerce payment processing system directly from the website. It is your responsibility to provide lawful, accurate and current details for the bank account or credit card you have selected to use to make all payments made by you in accordance with the agreement and ensure that you maintain sufficient funds and/or credit in that account/on that credit card to enable you to do so. Payment confirmation is required prior to your listing going live on FAOs directory as per clause 6 of this document.
9. Pricing. The price of the membership, including where applicable any introductory pricing for a specified period will be displayed at the time of purchase. All prices include GST unless otherwise specified. FAO may amend the pricing schedule by giving 28 days prior notice to you. Once new pricing takes effect FAO may alter your automatic payment arrangements accordingly. Where your membership is for a specified plan period, FAO will not change the pricing for that period or fixed term membership during that term.
10. Terminations/cancellations. Unless terminated in accordance with our terms of use policy, the membership agreement is ongoing and will continue until cancelled. FAO reserves the right to terminate this agreement and remove your business listing from the website if any terms and conditions or code of conduct breaches occur. FAO reserves the right to remove or amend any member Business Listing or any content provided in a Business Listing, or terminate your membership for any reason at any time, at the sole discretion of FAO, without the need to provide notice or an explanation and without any damages applying.
11. Commission. FAO does not receive fees or commissions to allow visitors accessing the website or for facilitating engagement with members.
12. Listing Fees and cancellations. Membership fees consist of a charge of an amount commensurate with the membership plan selected that will automatically renew if not cancelled. Your membership will be auto-renewed unless you provide a cancellation request, in writing, 10 business days prior to your subscription renewal date. FAO reserves the right to reject your application for subscription at any time without disclosing reasons for the termination. Subscriptions are non-transferable.
13. Refunds. Refunds of subscription fees in limited circumstances such as if your subscription application has been declined or where exceptional circumstances prevent you from continuing your subscription. Members are required to submit a refund request via the support email address for review.
14. Confidentiality. Both FAO and its members agree not to disclose or permit to be disclosed either directly or indirectly in any manner whatsoever information of the other party which is, or ought to be reasonably expected to be, confidential to any person other than a person to whom such disclosure is necessary to give effect to the agreement or as required by law.
15. Privacy. FAO is committed to the protection of our members in accordance with the Australian Privacy Principles set out in the Privacy Act 1988. FAO does not and will not sell, rent or share our membership data or membership mailing list. FOA does not disclose personal information to third parties with the express permission of the individual concerned. You consent to us collecting your personal information in accordance with the terms of our privacy policy. FAO keeps membership and subscriber details on controlled facilities that are secured against unauthorised access.
